a) Users

• The user exempts the instructor and the organizer of the yoga sessions, or of any other nature, all responsibility for any claim, complaint, damage, personal injury, or illness suffered by the user during the sessions or in any activity related to them.

b) The service provider

• As lenders, we are obligated to lend the subscribed services, respond to client complaints, effectively guarantee the privacy of communications and repair problems that could occur in the technological infrastructure necessary for the lending of the services.
• Kavaalya will not be responsible, neither indirectly nor secondarily, for economic loss or loss of good repute, nor for any type of special damages, indirect or emergent, resulting from the use of the website or of the yoga sessions or of any other nature, on the part of the user.
• From the website it is possible to be redirected to content of third party websites. The lender cannot control the content introduced by third party websites and as such is not responsible for them nor for the effects they may have.
• Kavaalya is allowed to terminate, suspend, or interrupt unilaterally, at any moment and without required notice, the lending of services and of the portal and/or any of the services therein.
• Kavaalya does not guarantee the availability, the access, and/or the continued use of the portal and its services. For its part, Kavaalya will not be held responsible for damages and losses caused by the user as a consequence of unavailability, access failures, lack of continuity of the portal and its services. This website has been revised and tested so that it functions correctly. In principle, it can guarantee function operation 365 days of the year, 24 hours a day. Nevertheless, the lender does not discount the existence of the possibility of certain errors in programming, or the occurrence of force majeure, natural disasters, strikes, or unforeseen circumstances that make accessing the web page impossible. We reserve the right to temporarily suspend, if necessary without notice, the accessibility to our site if it is affected by maintenance, repairs, updates, or improvement of services, as well as modify the conditions of access to it.
• The lending of services and/or content of the Portal has an indefinite duration.

Right of Admission:

Kavaalya reserves the right to reject admission to any of our events like training courses, retreats, etc without citing a cause. In that case, if admission is rejected for any reason at the discretion of Kavaalya, after the deposit or full payment was made, said payment will be refunded to the user within 15 days of receiving it.

If a student arrives late to the start of the course, they might be rejected by Kavaalya. We will analyze the circumstances of each case acting in the best interest of the group.

Intellectual Property :

It applies to:

• The graphic material or any other type of material that forms part of the courses, classes, retreats, sessions, webinars, etc, organized by Kavaalya and lent through any medium, such as: the website, email, third-party platforms like “Teachable”, etc.
• The graphic material or material of any other nature recorded during the courses, classes, retreats, webinars, etc lent in-person or online

Independent of the use for which they were designed, the recording, partial or complete copying, use, exploitation, distribution or commercialization, in all cases requires prior written authorization by Kavaalya. Any use previously unauthorized by the lender will be considered a serious infraction on the rights of intellectual property or author’s rights.

The designs, logos, text and/or graphics not belonging to the service provider that may appear on the website, belong to their respective owners, who are themselves responsible for any possible controversy that could arise about them.

The graphic material taken during the courses, workshops, retreats, or in-person or online classes, can be used in any form that Kavaalya sees fit, including advertising or promotion, such as on social networks, the website of the company, etc. Upon accepting these terms and conditions, the students give full permission for the recording and publication of this type of material.

Kavaalya is not responsible for the use of graphic material taken by the students or teachers.

The materials that form part of any course, class, workshop, or retreat, including among others, the manuals, the general design of the Kavaalya website, the logos, the trademarks, and the content of the web pages are the property of Kavaalya. Recording and/or sharing this information with third parties and/or using it for monetary gain is strictly prohibited without prior express written consent of Kavaalya.

Unless otherwise notified, we understand that your data has not been modified, you pledge to notify us of any changes, and we have your consent to use them for the aforementioned reasons.

Kavaalya informs you that we will proceed to use your data in a lawful, legal, transparent, appropriate, pertinent, limited, accurate and updated manner. Therefore, Kavaalya pledges to adopt all reasonable measures to remove or rectify them without delay when they are inaccurate.

Kavaalya can share your contact information (name, email address, phone number, address, and more) with the associates of Kavaalya, like Yoga Alliance Professional.

Electronic Trade:

Kavaalya does not guarantee placement in any of our in-person courses until we have received 100% of the deposit and have communicated confirmation of the reservation to the student. Upon making the final payment the students must prove their identity and attach a photocopy of their passport and visa.

Kavaalya has full authority to offer discounts and payment methods at any time and to any student, group, or organization. This does not mean that other students would have access to the same discounts or conditions.

Kavaayla does not accept any responsibility for cancellations, delays, changes, or losses as a result of causes of force majeure such as communications interruptions, war and threats of war, airport closures, civil unrest, natural disasters, accidents, or any other event out of our control. This includes injuries, illnesses, medical or psychiatric afflictions of the students developed during or after the course, such as personal property loss or damage during the training and time at the center.

In the unlikely event that a program is canceled or removed from Kavaalya, 100% of the payment will be reimbursed, or an alternative retreat or course will be offered at another time and place. When a student cancels enrollment for any reason, the deposit is not refundable. The transfer of the deposit to another course, for unusual circumstances, will be at the discretion of the management of Kavaalya.

Kavaalya does not accept responsibility for any financial or other kind of loss, including costs of flights, for cancelation of classes, sessions, courses, or retreats.

Kavaalya will refund the money of the people who, during the first 24 hours of any course, decide they do not want to continue with the program. This only applies to programs lasting 3 or more days.

Kavaalya reserves the right to cancel any of the programs up to 3 days before the start date.

Refunds will be issued after a period of 15 days.

Injuries or illnesses before, during, or after the training:

Upon participating in the in-person or online classes, the students accept that they possess the control and direction of all of the activities and voluntarily assume all responsibility and accept any and all risks or damages, including physical injuries and discomforts that come about during the programs, or that occur as a result of participation in the activities.

Kavaalya doesn’t accept responsibility for any injuries or illnesses that the students suffer during the training, workshops, retreats, or classes inside or outside of the center.

The students assume the responsibility of consulting a doctor beforehand regarding their participation in the events of Kavaalya, and accept that Kavaalya has no medical obligation or responsibility to their students.

Collecting information about the medical/health condition of the students does not presume assumption of responsibilities.

The nature of a yoga course, retreat, workshop, and in-person class, includes a certain level of interpersonal physical contact. Upon participation in this yoga event, the students voluntarily accept this contact and understand its professional nature.

Policy Changes:

Kavaalya reserves the right to revise and change these terms and conditions at any given moment, in which case the changes will be published on this website.

Program Changes:

Kavaalya reserves the right to change the program or syllabus, without notification.
